Hereinafter referred to as "Boulevard Bikes" or the "Controller".
1. Boulevard Bikes issues this statement (hereinafter referred to as the “Privacy Statement”) for the purpose of transparently informing Users (as defined below) about the website operated at the following address: www.rentabike.be (hereinafter referred to as the "Site") and about how personal data is collected and processed by Boulevard Bikes.
2. The term "User(s)" refers to any user, whether an individual or a legal entity, who visits the Site or interacts with it in any way.
3. In its capacity as the Data Controller, Boulevard Bikes determines all technical, legal, and organizational measures, as well as the purposes for the processing of Users’ personal data. Boulevard Bikes agrees to take all necessary measures to ensure that the processing of personal data is carried out in accordance with the Act of July 30, 2018, on the protection of natural persons with regard to the processing of personal data (hereinafter referred to as the “Act”) and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (i.e., the General Data Protection Regulation (GDPR); hereinafter referred to as the “Regulation”).
4. Boulevard Bikes is free to select any natural or legal person to process Users’ personal data at its request and on its behalf (hereinafter referred to as the “Processor”). In that case, Boulevard Bikes agrees to select a Processor that provides sufficient guarantees regarding the technical and organizational measures for the processing of personal data, in any event in accordance with the Act and the Regulation.
II. Processing of Personal Data
5. Users’ visits to and use of the Site may result in the collection of personal data. The processing of this data by Boulevard Bikes, in its capacity as the data controller, or by processors—service providers acting on behalf of and for the account of Boulevard Bikes—is always carried out in accordance with the law and the regulation.
6. Boulevard Bikes processes personal data in accordance with the purposes set forth in the following provision, using the following methods:
Boulevard Bikes may, to the extent permitted by law and regulations, collect personal data from users via public databases, social media, or owners of marketing databases, which help Boulevard Bikes update, improve the quality of, and supplement users’ personal data, particularly to enable Boulevard Bikes to better understand which products interest users;
When a User visits the Site, Boulevard Bikes also collects personal data, particularly when Users fill out forms to inquire about services;
Boulevard Bikes also automatically collects personal data through the use of cookies (as defined below) and similar technologies;
Boulevard Bikes collects personal data in the following cases:
When the User fills out forms or schedules an appointment through the Site or other Boulevard Bikes channels;
When the User enters into an agreement with Boulevard Bikes for the purchase of a product or service;
When the User contacts Boulevard Bikes, for example, when they write to Boulevard Bikes’ customer service;

III. Purpose of the processing of personal data
7. In accordance with Article 13 of the Regulation, Users are informed of the purposes of the processing of personal data. These purposes are as follows:
Ensuring that requests for information are followed up on;
Contacting the User by phone or email when necessary to provide Boulevard Bikes’ services;
To inform the User about Boulevard Bikes’ services and products, in accordance with his or her specified communication preferences;
Send the User marketing materials in accordance with his or her specified communication preferences;
Detecting, identifying, and investigating crimes (such as invoice fraud);
The enforcement of legal claims and the management of disputes, as well as representation in legal proceedings.
IV. Personal Data That May Be Processed
8. The User agrees that Boulevard Bikes may collect and process the following personal data during the User’s visit to and use of the Site:
First and last name;
Phone number;
Email address;
Information about the services in which the user is interested.
V. Consent
9. Boulevard Bikes collects and processes this personal data in accordance with the terms and principles described in this Privacy Statement.
10. By accessing and using the Site, the User declares that he or she has given his or her free, specific, informed, and unambiguous consent to the processing of his or her personal data. This agreement relates to the content of the Privacy Statement.
11. Consent is given through the positive and active action by which the User checks the box for the Privacy Statement on the Boulevard Bikes website. This consent is an essential condition for performing certain actions on the Site or for enabling the User to enter into a contractual relationship with Boulevard Bikes. Any agreement between Boulevard Bikes, on the one hand, and a User, on the other hand, regarding the services and goods offered on the Site is subject to the User’s acceptance of the Privacy Statement.
12. The User agrees that Boulevard Bikes may collect and process the personal data that he or she provides on the Site or in connection with the services offered by Boulevard Bikes, in accordance with the terms and principles set forth in this Privacy Statement, for the purposes stated above.
13. The User has the right to withdraw his or her consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on prior consent.
VI. Retention Period for Users’ Personal Data
14. In accordance with Article 13(2) of the Regulation, Boulevard Bikes, in its capacity as data controller, retains personal data only for as long as is reasonably necessary to fulfill the purposes for which it is processed.
15. In any event, personal data will not be retained for longer than is necessary for the performance of the agreement.
VII. Recipients of Data and Disclosure to Third Parties
16. Personal data may be disclosed to employees, staff members, subcontractors, processors, or suppliers of Boulevard Bikes, provided that adequate safeguards are in place to ensure the security of such data and provided that they are working with Boulevard Bikes to market products or provide services. They act under the direct authority of Boulevard Bikes and are specifically responsible for the collection, processing, or outsourcing of this data.
17. In all cases, the recipients of the data and those to whom the data is disclosed shall comply with the terms of this Privacy Statement. Boulevard Bikes ensures that they process this data only for the intended purposes and in a discreet and secure manner.
18. If the data is to be disclosed to third parties for the purposes of direct marketing or prospecting, the User will be notified in advance so that he or she may give explicit consent to this use of personal data.
VIII. User Rights
19. The User may exercise his or her rights at any time by sending an email to the following address: info@boulevardbikes.be or by sending a letter by mail, accompanied by a copy of his or her ID card, to the following address: Zeedijk-Knokke 637, 8300 Knokke-Heist.
20. In accordance with Article 15 of the Regulation, Boulevard Bikes guarantees the User’s right of access to his or her personal data. The User has the right to access this personal data and the following information:
The categories of personal data involved;
The recipients or categories of recipients to whom the personal data has been or will be disclosed;
Appropriate safeguards where the recipients are located in third countries or are international organizations;
If possible, the proposed retention period for personal data or, if this is not possible, the criteria used to determine this period;
The existence of automated decision-making, including profiling, as referred to in Article 22(1) and (4) of the Regulation and, at least in those cases, the relevant information regarding the underlying logic as well as the significance and the expected consequences of such processing for the data subject.
21. Boulevard Bikes may charge a reasonable fee to cover administrative costs for additional copies requested by the User.
22. If the User submits this request electronically (for example, via email), the data will be provided in electronic form and for general use, unless the User requests otherwise.
23. A copy of the data will be provided to the user no later than one month after receipt of the request.
Right to correction
24. Boulevard Bikes guarantees the right to correct and delete personal data.
25. In accordance with Article 16 of the Regulation, incorrect, inaccurate, or irrelevant data may be corrected or deleted at any time. The User shall first make the necessary changes themselves via their user account, unless these cannot be made independently, in which case the request may be directed to Boulevard Bikes. Boulevard Bikes strives to respond as soon as possible, but in any case within one month.
26. In accordance with Article 19 of the Regulation, Boulevard Bikes shall notify each recipient to whom personal data has been disclosed of any rectification of the personal data, unless such rectification proves impossible or involves disproportionate effort. Boulevard Bikes shall provide the data subject with information about these recipients if the data subject so requests.
Right to erasure
27. The user has the right to have their personal data erased as soon as possible in the cases referred to in Article 17 of the Regulation.
28. If Boulevard Bikes has disclosed the personal data and is required to erase it pursuant to the preceding provision, Boulevard Bikes shall, taking into account available technologies and the associated costs of implementation, take reasonable measures, including technical measures, to inform other controllers processing such personal data that the data subject has requested these controllers to delete the link to this personal data or a copy or reproduction thereof.
29. The two preceding provisions do not apply to the extent that such processing is necessary:
For the exercise of the right to freedom of expression and information;
(i) to comply with a legal obligation to process data under Union law or the law of the Member State to which Boulevard Bikes is subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in Boulevard Bikes;
For the establishment, exercise, or defense of legal claims.
30. In accordance with Article 19 of the Regulation, Boulevard Bikes shall, prior to processing, notify each recipient to whom personal data has been disclosed of the erasure of personal data or of any restriction on processing, unless this proves impossible or involves disproportionate effort. At the request of the data subject, Boulevard Bikes shall provide him or her with information about these recipients.
Right to restriction of processing
31. The User has the right to request the restriction of the processing of his or her personal data in the cases referred to in Article 18 of the Regulation.
32. In accordance with Article 19 of the Regulation, Boulevard Bikes will notify each recipient to whom the personal data has been disclosed of any restriction, unless this proves impossible or involves a disproportionate effort. Upon request, Boulevard Bikes will provide the data subject with information about these recipients.
Right to data portability
33. In accordance with Article 20 of the Regulation, users have the right to receive their personal data from Boulevard Bikes in a structured, commonly used, and machine-readable format. Users have the right to transmit this data to another controller without hindrance from Boulevard Bikes, in the cases provided for by the Regulation.
34. When the User exercises his or her right to data portability pursuant to the preceding provision, he or she has the right to have personal data transferred directly from one controller to another, to the extent that this is technically feasible.
35. The exercise of the right to data portability does not affect the right to erasure. This right does not apply to processing that is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in Boulevard Bikes.
36. The right to data portability does not affect the rights and freedoms of third parties.
Right to object and automated individual decision-making
37. The User has the right at any time to object to the processing of his or her personal data on the grounds of his or her specific situation, including the automated processing of data by Boulevard Bikes. In accordance with Article 21 of the Regulation, Boulevard Bikes will no longer process personal data unless there are legitimate and compelling reasons for the processing that outweigh the interests, rights, and freedoms of the User or for the establishment, exercise, or defense of legal claims.
38. When personal data is processed for marketing purposes, the User has the right at any time to object to the processing of personal data concerning him or her for such marketing purposes, including profiling to the extent that it relates to such marketing.
39. If the data subject objects to the processing of their personal data for marketing purposes, Boulevard Bikes will no longer process that data for that purpose.
Right to file a complaint
40. The User has the right to file a complaint regarding the processing of his or her personal data by Boulevard Bikes with the Data Protection Authority responsible for the Belgian territory. 42. The User may also file a claim for an injunction with the presiding judge of the court of first instance in their place of residence.
IX. Cookies
43. The Site uses cookies (as defined below) to distinguish between users of the Site. This allows us to provide Users with a better browsing experience and to improve the Site and its content. The purposes and methods of Cookies (as defined below) are set forth in the following provisions.

General Principles
44. (A) "Cookie(s)" are files that are stored temporarily or permanently on the User's computer, tablet, or smartphone during their first visit to the Site. These Cookies enable the server to recognize the User's device.
45. Cookies may also be placed by third parties with whom Boulevard Bikes collaborates.
46. Some of the cookies used by Boulevard Bikes are necessary for the proper functioning of the Site, while others are necessary to optimize the User’s experience.

Cookie retention period
50. The retention period for the collected personal data may differ from the retention period (lifespan) of the cookies. Boulevard Bikes never retains cookies for longer than is necessary for the purpose of processing for which the personal data was collected.

X. Protection of Personal Data
55. Boulevard Bikes agrees to take reasonable physical, technological, and organizational precautions to prevent (i) unauthorized access to users’ personal data and (ii) the loss, misuse, or alteration of such personal data. Despite Boulevard Bikes’ security policies and its assessments in this area, an infallible level of security cannot be guaranteed. No method of transmission or transfer over the internet, nor any other method of electronic storage, is 100% secure; therefore, Boulevard Bikes cannot guarantee absolute security in this context.

56. The Site may contain hyperlinks to other websites. Boulevard Bikes is in no way responsible for the privacy and cookie policies or practices of other parties.
XII. Changes to the Privacy Statement or Cookie Policy
57. Boulevard Bikes reserves the right to amend this Privacy Statement and the Cookie Policy described therein in order to (continue to) comply with applicable legal obligations. Users are therefore requested to consult the Privacy Statement regularly to stay informed of any changes or updates. XIII. Governing Law and Jurisdiction
58. This Privacy Statement is governed exclusively by Belgian law. Any dispute shall be submitted to the courts of the judicial district in which Boulevard Bikes has its registered office.
